Essential Businesses & Operations – Providing Employees “Permits”

By now, most companies and organizations have already determined if they meet the definition to be considered Essential Businesses/Operations, as defined in the State of Ohio Department of Health Order, dated March 22, 2020, or some other exemption that allows some or all of your employees to come to work.  Governor DeWine has been clear that enforcement of this Order will be allowed by the state and local enforcement officers and the state and local health departments.  At this point, the State of Ohio will not be issuing documents to prove essentialness.  That said, it is this law firm’s advice that you provide your employees if they are working, a letter which “proves” that they work for an Essential Business or Operation (or are performing Minimum Basic Functions for a non-Essential company) and, as a result, can travel to and from their place of work.   This may be more for your employees’ peace of mind than anything else. It will likely have no legal significance but it may have a practical use. This letter combined with a recent pay stub or an Employee ID card may be helpful to avoid further questioning or any complications.
