Increased Penalties for Violations of Federal Employment Law Posting Requirements Effective July 5

Effective July 5, 2016, the Equal Employment Opportunity Commission raised the penalty for employers who fail to properly post required workplace notices required under several federal statutes including Title VII, the Americans with Disabilities Act (ADA), and Genetic Information Non-Discrimination Act (GINA). Previously the penalty was $210 per violation and now has been raised to $525 per violation.

Employers are required to post notices describing the relevant provisions of Title VII, the ADA, and GINA in a prominent and accessible place where notices to employees are usually posted. The notice requirement applies to employers with 15 or more employees, including state and local governments and schools and school districts. The new penalty does not apply to violations before July 5. Please review your current postings and confirm your organization’s compliance with the requirement.
